TERMS AND CONDITIONS FOR THE PROVISION OF ELECTRONIC SERVICES AND SUBSCRIPTION SALES OF THE CAMPATLAS PLATFORM
These Terms and Conditions define the rules for using the CampAtlas internet platform, available at www.campatlas.eu, the conditions for concluding agreements for the supply of Digital Content (map subscription), the rights and obligations of the parties, and the complaint procedure.
§ 1. DEFINITIONS

Operator / Seller – TOSANUS PaweÅ‚ Tomczak, Aleja Spacerowa 62, 05-825 Książenice, NIP (Tax ID): 957-028-59-78, REGON (Business ID): 366828244, kontakt@campatlas.eu.

Platform / Website – the internet service located at www.campatlas.eu, also operating as a Progressive Web App (PWA), through which the User can obtain access to the Map.

Map – an interactive map of caravanning infrastructure in Poland, based on the Google Maps engine, containing a database of spots classified in 15 categories.

User – any natural person, legal person, or organizational unit without legal personality using the Website.

Consumer – a User who is a natural person making a purchase for purposes not directly related to their business or professional activity.

Entrepreneur with Consumer Rights (PNPK) – a natural person concluding an agreement directly related to their business activity, when the content of this agreement indicates that it does not possess a professional character for them.

Subscription / Premium Access – a paid service consisting of granting access to the full content of the Map for a specified period of time.

Premiere Access – a special subscription variant launched in June 2026, remaining valid until December 31, 2027.

Payment Operator – an external payment service provider enabling fast online transactions, including BLIK payments and payment cards.

Digital Content – data produced and supplied in digital form, in particular the interactive database of the Map.
§ 2. GENERAL PROVISIONS AND TECHNICAL REQUIREMENTS

The Terms and Conditions are continuously and free of charge available on the website www.campatlas.eu in a manner that allows them to be downloaded, reproduced, and recorded.

To use the Platform and the full content of the Map, the following are necessary:

A terminal device (computer, tablet, smartphone) with access to the Internet.

A current version of a web browser supporting HTML5 and JavaScript technology.

An active GPS location function (optional, for the purpose of centering the Map around the User's position).
-
In order to use the features of the mobile application – a browser supporting the Progressive Web App (PWA) standard allowing the addition of a shortcut to the device's home screen.

The User is prohibited from providing content of an unlawful nature and from taking actions that may disrupt the functioning of the Website, in particular the automated downloading (scraping) of the Map database.
§ 3. SERVICES PROVIDED ELECTRONICALLY

The Operator provides the following free services through the Platform:

Providing public informational and marketing content.
-
A contact form and a form for reporting feedback regarding spots on the map.

Providing a demonstration version of the Map (the so-called "Demo Version" covering a limited number of 34 test spots).

The Operator provides a paid service in the form of granting access to the Full Version of the Map (Digital Content) after purchasing a Subscription.
-
The agreement for the provision of free services is terminated upon leaving the Platform or submitting a form. The conditions for the duration of the Subscription agreement are specified in § 4.
§ 4. CONCLUSION OF THE AGREEMENT AND SUBSCRIPTION TERMS

The conclusion of the agreement for the provision of Premium Access (Subscription) takes place by completing the purchase procedure on the Website and paying the fee.

The subscription price list is as follows:

Premiere Access (purchased by July 31, 2026, valid until 31.12.2027): 39 PLN or 9.90 EUR.

Regular Access (purchased from August 1, 2026, valid until 31.12.2027): 59 PLN or 14 EUR.

All prices listed on the Website are gross prices (inclusive of tax).

The purchase procedure includes:
-
Choosing the payment currency variant (PLN/EUR).
-
Providing an e-mail address to which access will be authorized or confirmation of the contract will be sent.
-
Accepting these Terms and Conditions and the Privacy Policy.
-
Expressing consent to the provision of Digital Content before the expiry of the deadline to withdraw from the contract (in accordance with § 6).
-
Redirection to the Payment Operator in order to pay the fee using the BLIK system or a payment card.
-

The agreement is concluded upon the Operator receiving confirmation of successful transaction authorization from the Payment Operator.
-
Activation of access to the full Map takes place automatically and immediately after finalizing the payment. The User gains access to a secured subpage containing the Map.
-
Access is assigned to a single user account and is intended solely for personal use. It is forbidden to share the account with third parties, resell access, or use CampAtlas data to build competitive databases.
§ 5. CHARACTER AND UPDATING OF DATA (SPECIFICITY OF THE MAP)

The Map constitutes an original collection of data and information of an independent nature. None of the facilities listed on the Map pay any fees for their presence in the database, which guarantees the objectivity of the presented information.

The User acknowledges that caravanning infrastructure is subject to dynamic changes. The Operator makes due efforts to continuously verify and update the data.
-
Due to the completeness of the database, the Map contains facilities of varying standards (including spots with extreme, debatable opinions or humble sanitary infrastructure). The choice of a specific place and the assessment of whether it meets individual expectations rests solely with the User.

The Map contains only selected "wild" locations (e.g., designated forest parking lots of the State Forests). The Website is not and does not aspire to be a complete directory of wild, unofficial stopovers. The Website bears no responsibility for the legal status of the indicated "wild" spots and does not guarantee the legality of using them as caravanning overnight stays.

Users can report errors, outdated spots, or changes in infrastructure using a dedicated form. For proper identification of a spot, it is required to provide a unique identification code with the structure CAP-0000, visible on the card of the given place.
§ 6. RIGHT TO WITHDRAW FROM THE AGREEMENT

In principle, Consumers and PNPK have the right to withdraw from a distance agreement within 14 days without giving any reason.

NOTE - EXCLUSION OF THE RIGHT TO WITHDRAW: In accordance with Art. 38 clause 1 item 13 of the Consumer Rights Act, the right to withdraw from an agreement for the supply of digital content that is not recorded on a tangible medium does not apply if the performance has begun with the express consent of the Consumer or PNPK before the expiry of the deadline to withdraw from the contract and after the Operator has informed them about the loss of the right to withdraw from the contract.

By finalizing the purchase and immediately launching Premium Access (clicking on the subpage with the Map and loading the database) with the User's prior consent, the User loses the right to withdraw from the agreement.

In the case of free services (provided electronically), the User may opt out of them at any time without incurring costs.
§ 7. COMPLAINT PROCEDURE AND LIABILITY

The Operator is liable to the Consumer and PNPK for the conformity of the Digital Content with the agreement under the rules specified in Chapter 5b of the Consumer Rights Act.

Complaints regarding the operation of the Platform, Subscriptions, or billing irregularities must be submitted electronically to the e-mail address: kontakt@campatlas.eu or through the contact form on the Website.

A properly submitted complaint should include: the User's identification data (including the e-mail address used for the purchase), a description of the problem, and the complaint request.
-
The Operator considers complaints within 14 days from the date of their receipt and provides a response to the User's e-mail address.
-
The Operator is not liable for:
-
Damages resulting from incorrect use of the Map by the User.
-
Administrative decisions, fines, or ownership disputes arising as a result of the User parking at locations marked on the Map (the User is obliged to verify the factual situation and road signs/regulations at the stopover site each time).

Short-term technical breaks in the operation of the service resulting from maintenance work or independent failures (e.g., interruptions in the operation of external services like Google Maps or Google Sheets).

§ 8. PERSONAL DATA PROTECTION (GDPR)

The administrator of the Users' personal data is the Operator.
-
Personal data are processed for the purpose of:
-
Performance of the agreement for the supply of Subscription/Digital Content (Art. 6 clause 1 lit. b GDPR).
-
Handling form submissions and complaints (Art. 6 clause 1 lit. c GDPR).
-
Fulfilling legal and tax obligations related to sales (Art. 6 clause 1 lit. c GDPR).
-
The legally justified interest of the Administrator, which is defense against claims and contact with the User (Art. 6 clause 1 lit. f GDPR).

Users' personal data may be transferred only to entities authorized to receive them on the basis of legal provisions and technical partners (Payment Operator, hosting provider). Data are not transferred to third countries outside the European Economic Area (EEA) in a manner inconsistent with GDPR.

The User has the right to access their data, rectify them, erase them ("the right to be forgotten"), restrict processing, data portability, and object. The User also has the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO).

Detailed rules of data processing, cookie policy, and technical security measures are described in the CampAtlas Privacy Policy document, which constitutes an integral part of the Website documentation.
§ 9. FINAL PROVISIONS

In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

The Operator reserves the right to change these Terms and Conditions for important technical, legal, or organizational reasons (e.g., change in subscription prices, change in technology). Changes to the terms and conditions do not affect the rights acquired by Users before the day the changes enter into force (current subscriptions continue under the previous terms).

The Consumer has the possibility to use out-of-court methods of handling complaints and pursuing claims, including via the EU ODR platform available at: http://ec.europa.eu/consumers/odr/.

These Terms and Conditions enter into force on June 1, 2026.
